New York state lawmakers have rejected Governor Kathy Hochul’s proposed changes to the state’s surprise medical billing dispute resolution system, intensifying the ongoing conflict between insurers and healthcare providers over out-of-network payments. In their recently released one-house budget plans, both the state Senate and Assembly excluded Hochul’s reforms targeting the Independent Dispute Resolution (IDR) process, which arbitrates payment disagreements between insurers and providers.

Hochul’s proposal aimed to reduce state healthcare expenditures by an estimated $56 million annually. Key components included exempting Medicaid from the IDR process and incorporating the Empire Plan—which covers state employees—into the dispute resolution framework. Additionally, the governor sought to recalibrate arbitration benchmark rates to reflect average private insurer payments rather than provider charges, a move insurers argue would better mirror market realities.

The legislature’s resistance highlights the entrenched divide between medical providers, who argue that lowering arbitration accessibility and reimbursement rates could jeopardize patient access to care and fair compensation, and insurers, who have criticized the rapid rise in out-of-network payment rates.
