New York Legislature Rejects Hochul’s Surprise Billing Reforms, Aligning with Providers

April 13, 2026 · 8:28 pm EDT · 1 dk okuma

New York state lawmakers have declined Governor Kathy Hochul’s proposed reforms aimed at changing how surprise medical billing disputes are resolved, signaling a clear legislative alignment with doctors and hospitals over insurers. The governor’s budget plan called for an overhaul of the independent dispute resolution (IDR) process—a behind-the-scenes arbitration used when providers and insurers cannot agree on payment for out-of-network services. However, both the State Senate and Assembly excluded these reforms from their separate one-house budget proposals released Monday.

Hochul’s plan sought to exempt Medicaid from the IDR process and bring the state’s Empire Plan, which covers state employees, under the same changes. The governor’s office projected these steps would save $56 million annually. Central to the proposal was lowering the benchmark rates used in arbitration by basing them on average private insurer payments rather than provider charges. Advocates argued this would better reflect prevailing market rates and curb soaring reimbursements for out-of-network care.

The legislative pushback reflects a broader dispute between medical providers and insurers over reimbursement fairness. Insurers support Hochul’s reforms, citing escalating costs tied to out-of-network payments. In contrast, doctors and hospitals contend that restricting access to the arbitration process could limit their negotiating power and ultimately reduce patient access to care. The legislature’s decision underscores the influence of healthcare providers in New York’s policymaking landscape, particularly amid ongoing debates about healthcare affordability and provider compensation.

This development adds complexity to New York’s healthcare cost containment efforts, as the state continues grappling with balancing insurer cost controls and provider payment adequacy. With the budget process advancing, stakeholders will closely watch whether any compromise emerges to address surprise billing disputes without alienating key constituencies. For New York’s expansive healthcare ecosystem, these decisions bear significant implications for payment dynamics and patient billing protections going forward.
